Role of Judiciaries in Protecting Refugees’ Rights in India and Nepal

Abstract
The juridical basis of the international commitments to defend refugee rights,namely:Non-refoulement, incorporating non-rejection clauses at the border, non-extradition, non-expulsion, and non-return as well as the minimum standard of behavior, are traced in international treaties and normal laws. The only convention and agreement having a common outcome upon refugees is the Convention Relating to the Status of Refugees 1951and its 1967 protocol on the status of refugees and asylum seekers which is the Magna Carta of refugee law.The courts of India and Nepal have been playing very crucial role in protecting the rights of asylum seekers and refugees, who are staying within their territories.
